Max Bet Casino Tours Hold Harmless Agreement
General – This agreement is between Max Bet Casino Tours (“MBCT”, “we”, “our”, “us”) and its patron (“you”, “your”), by which you hold harmless MBCT, its agents and employees from all liabilities, charges, expenses and costs on account of or by reason of any injuries, death, liabilities, claims, suits or losses that may occur during any MBCT event. This agreement or any part thereof including future events will be for the life of the patron and/or the duration of MBCT.
MBCT acts only as an agent in arranging motor coach charters, tickets, as well as other services and does not assume any liability for injury, damage, loss, or delay due to any policy or act of any person or entity other than MBCT. Our vendors work independently of our influence.
MBCT cannot be held liable for any negligence, lack of performance, or changes by any of our vendors, including but not limited to casino packages, motor coach amenities or ticket availability. MBCT cannot be held responsible for changes in the itinerary due to weather, traffic, mechanical failure, or similar circumstances beyond our control. There are no refunds given unless trip is canceled by MBCT.
MBCT reserves the right to decline acceptance of any person on their tours for any violation of any policies both written here or elsewhere.
MBCT will not share your information with anyone outside of our vendors for the sole purpose of the event you are attending. This includes, but not limited to, casinos, transportation services, parking area, hotels, MBCT representatives, etc.
The MBCT representative will be your main point of contact. If you have any issues or concerns, please bring it to the attention of us or the driver, on your particular trip. They will be more than happy to try and help. Both employees of MBCT and its vendors should be treated with respect at all times. This includes hotel staff, casino staff, drivers, restaurant employees, etc.
Marketing – All information viewed by patrons, including but not limited to: marketing material, website, social media and/or verbal correspondence with MBCT representatives, etc., are as accurate as we could have known at the time the information was disseminated. MBCT reserves the right to make minor changes to the trips to keep from completely canceling the trip without prior notice. This includes dates, times, accommodations, menus, inclusions, etc.
Possession/Consumption – This agreement is made with the understanding there is to be no possession or consumption of any weapons, alcohol or drugs of any kind on the bus. No smoking of any kind is permitted on the bus. All Casino rules must be followed at all times while on their premises. Patrons are allowed to consume alcohol in moderation but must do so responsibly. Excessive use of alcohol will not be allowed. It will be up to the discretion of MBCT, its employees, and other vendors being used, on what constitutes excessive use. MBCT, its employees, and vendors are not responsible for individuals who consume alcohol or their actions. Patrons found to be under the influence are subject to removal from the motor coach or vendor’s property if it is deemed by a representative to be in their best interest or the interest of others. Those removed will not receive any compensation for any parts of a tour missed or for other needs such as transportation, food, and/or accommodations.
Lost and Found – If items are found on the motor coach they will be turned into the MBCT representative. Any items found can be picked up within 2 weeks after a trip returns. Please call/text our office at 865-300-0716 to make arrangements. MBCT cannot be held responsible for items left on a motor coach or at a vendor location during or after a trip.
MBCT is not responsible for any theft or loss of possessions at any time. Keep all personal items on your person at all times. Do not leave items on the bus while in the casino, at rest stops, at additional pick up stops, etc.
Covid/CDC Guidelines – You understand that we are not liable for any sickness, including and not limited to Covid-19. MBCT and the patron is expected to follow all current CDC guidelines in the states in which we are traveling to. For example, if TN does not have a mask mandate and we are traveling to VA, and VA has a mask mandate, we will follow the VA guidelines. Otherwise, if not mandatory, please respect others’ (us, our vendors and other patrons) choices to wear a mask if they so choose.
Casino Age and Identification Policy – MBCT and its employees are not responsible for checking patron ID’s or verifying ages at any point before or during a trip. Casinos require valid identification. The most common identification is a current and valid driver’s license or state ID. The casino age requirement is 21+.
Seating – The first two rows of seating on all trips will be reserved for staffing/emergency purposes. You should not have coats, bags, or other personal items next to you as if to “block” off a seat. We ask that everyone be respectful of others. The MBCT representative will have the final say of any and all disputes. Failure to listen to us at any time may be cause for removal from the coach and/or not being allowed to book on future trips. Those removed will not receive any compensation for any parts of a tour missed or for other needs such as transportation, food, and/or accommodations.
Schedule – Out of respect for the other patrons, please make sure you are on time. This begins at the very first pickup and should continue throughout the duration of the trip. Customers who are tardy can run the risk of being left behind without transportation. Customers who are left will not be refunded for portions of the trip they have missed (i.e. Hotel, casino packages, shows, etc.) and will not be compensated for any additional cost incurred because the motor coach had left.
Restrooms – MBCT uses many different coach companies for transportation during their trips but the rules for the restroom apply to each company the same. With the exception of liquid waste, the bathroom should be limited to emergency uses only. By limiting the use of the bathroom you will make it a much more enjoyable time for all the customers on the motor coach.
Driver Info – It is a federal offense, punishable by as much as life imprisonment, for any person to threaten or interfere with the operation of, or to harm or to make any attempt to disable a commercial vehicle or its driver. We reserve the right to refuse to transport any person(s) whose actions the driver or MBCT representative deems, to be in violation of law, or any action that would affect the comfort of other patron or would interfere with the driver’s ability to operate safely. Persons who are removed will not receive a refund or any compensation for any fees incurred by being removed from the motor coach.
Gratuities – Gratuities are customary for drivers and MBCT reps, however, they are voluntary. They should be given to both the driver and MBCT representative based on a job well done on their individual performance.
Parking – MBCT, through third party vendors, offers several locations for you to park in which we have acquired permission for you to do so. However, parking in any lot with public access is done so at your own risk. MBCT, third party vendors, and the owner of the property (i.e. parking facilities) cannot assume any responsibility for theft, damage, vandalism, etc. that might occur to vehicles parked in any lot.
Special Requests – Customers must make MBCT aware of any special requirements at the time of booking. These may include handicap accessibility, seat requests, etc. Any requests will be passed on to the appropriate vendors, however, MBCT cannot guarantee the fulfillment of any requests because outside vendor’s decisions are outside of our control. With that said, the earlier a request is put in the better chances for a request to be honored.
